Tattoo waiver requirements in Florida
According to the Florida Department of Health (Chapter 64E-28, F.A.C.), your waivers must include the following:
Artist name
The name of the tattoo artist.
Customer identity
The customer’s name, age, and birthdate.
Tattoo description and placement
A description of the tattoo and its location on the customer’s body.
Customer signature
The customer’s signature.
Artist signature
The artist’s signature.
Procedure date
The date, or dates, the tattooing procedure was performed.
Minor restrictions and consent
No tattooing under 16. For ages 16–17, verify minor and parent or guardian photo IDs, collect any required proof of age, and obtain notarized parental consent on the state form.
Aftercare information
Aftercare information must be provided to the customer verbally and in writing.
Record retention
Keep customer records and minor consent forms for at least two years, and have current licensing-period records available onsite for inspection.

Both. Florida’s client record requirements include the customer’s signature and the artist’s signature as part of the record.
If a tattoo is done over multiple sessions, do we need to record each date?
Yes. Florida’s customer record requirements list the date, or dates, the tattooing procedure was performed, so multi-session work should reflect all session dates.
Do Florida rules require aftercare to be included in the waiver, or just provided separately?
Florida requires that aftercare information be provided verbally and in writing. Many studios include an acknowledgment line in the waiver/customer record confirming the client received both.
Do records have to be stored onsite in Florida, or can they be stored digitally/offsite?
Florida’s rule specifically expects current licensing-period records onsite and available for inspection. Digital records can work in practice as long as you can produce them immediately on site during an inspection.
What’s required for tattooing a 16–17 year old in Florida?
Florida requires photo ID verification for the minor and the parent/guardian and a notarized parental consent using the state form (and you must retain that consent with the customer record). Tattooing under 16 is not allowed.
