According to the Kansas Board of Cosmetology, K.A.R. 69-15-15 and related Kansas statutes require tattoo licensees to maintain and provide the following client records and information:
Client information and service details
Each client record must include the client’s name and address, the date and duration of each service, the type of identification presented, and the type of tattoo service provided.
Preservice written information
Before the procedure, the client must receive written information about possible reactions, side effects, potential complications, and special instructions related to medical or skin conditions. These include diabetes, allergies, cold sores or fever blisters, epilepsy, heart conditions, hemophilia, hepatitis, HIV or AIDS, blood-thinning medication, moles or freckles at the service site, psoriasis or eczema, pregnancy or nursing, scarring, and other relevant medical or skin conditions.
Minor consent
Tattooing a person under 18 requires prior written and notarized consent from a parent or court-appointed guardian, and the person providing consent must be present during the procedure. If consent is provided by a court-appointed guardian, a copy of the letters of guardianship must also be retained.
Service restrictions
Tattooing must not be performed on someone who is inebriated or appears incapacitated by alcohol or drugs, shows signs of recent intravenous drug use, or has sunburn, open lesions, rashes, wounds, puncture marks, or other skin diseases or disorders. Psoriasis or eczema in the treatment area also prevents the procedure from being performed.
Aftercare instructions
After every tattoo service, the client must receive aftercare instructions both verbally and in writing. The instructions must cover post-service care, possible side effects, and applicable restrictions.
Corrective work documentation
For corrective tattoo procedures, the artist must take photographs before and after the service. The artist keeps these photographs as part of the client’s record.
Record retention
Each individual client record must be kept for at least five years. This retention period also applies to corrective procedure photographs and required consent documentation for clients under 18.
