Tattoo waiver requirements in Mississippi
According to the Mississippi State Department of Health, Title 15, Part 19, Subpart 60, Chapter 11, tattoo consent forms and related client records must include the following:
Client information
Record the client’s name, home address, home telephone number, sex, and date of birth.
ID verification
Attach a photocopy of a government-issued identification containing the client’s date of birth to the consent form.
Tattoo record details
Document the date of the tattoo, its location on the body, the tattooist’s name and Department Certificate of Registration Number, the establishment name and address, and the supervisor’s name when the tattooist holds a Provisional Certificate of Registration.
Required signatures
The consent form must be signed by the client and tattooist. A supervisor’s signature is also required when applicable.
Consent and risk statements
The signed form must confirm that the client consents to the tattoo, understands the risks and aftercare responsibilities, has received written aftercare instructions, and is not under the influence of drugs or alcohol.
Medical warnings
The consent form must warn clients with diabetes, HIV infection, or End Stage Renal Disease that they face a higher risk of complications and should consult their physician. Clients with preexisting cardiac conditions must also be warned to seek physician permission before tattooing.
Special procedure notice
The consent form must include the Mississippi State Board of Health recommendation that tattooing involving mucous membranes be performed by a licensed physician or oral surgeon, as appropriate.
Aftercare instructions
Before tattooing begins, provide printed instructions covering care and cleaning of the tattooed area, signs and symptoms of infection, and when to consult a medical professional.
Record retention
Keep the original consent form and attached identification at the establishment for at least two years and make the records available to the Department upon request.
