Tattoo waiver requirements in North Dakota
According to North Dakota Administrative Code Chapter 33-41, tattoo establishments must maintain client records containing the following:
Client information
Record the client’s name, date of birth, address, and signature.
Procedure details
Document the date and time of the tattoo, the type or identification of the procedure performed, and its body location.
Operator information
Include the name of the operator who performed the tattoo procedure.
Signed release
Have the client sign a release confirming that the required health information was obtained or that the operator attempted to obtain it. The client must also be asked to disclose other information that could help evaluate the healing process.
Minor procedures
For a client under 18, a parent, legal custodial parent, or legal guardian must be present and provide written consent and proper identification. Proof of the required presence and consent must be retained with the client record.
Medical screening
Ask clients about diabetes; bleeding disorders; skin diseases or sensitivities; pigment or dye allergies; epilepsy, seizures, fainting, or narcolepsy; anticoagulants and other medications; hepatitis; HIV; high blood pressure or heart disease; pregnancy; contagious diseases; immune disorders; and serious physical or mental health problems.
Recordkeeping
Keep client records confidential, retain them for at least three years, and make them available to the Department upon request.
