Tattoo waiver requirements in Vermont
According to the Vermont Secretary of State, Office of Professional Regulation, tattoo consent forms and client records must include the following information and disclosures:
Client information
Keep the client’s name, residential address, and phone number as part of the individual client record.
Tattoo details
Record the date of the procedure and a description of the tattoo procedure performed.
Tattooist details
Include the name of the tattooist who performed the procedure.
Medical information
Record relevant medical conditions and include consent-form screening for heart valve conditions, herpes, latex or antibiotic allergies, diabetes, bleeding disorders, anticoagulant medications, blood-thinning medications, and autoimmune disorders.
Pre-procedure screening
The consent form must ask whether the client has used alcohol or drugs within the previous eight hours and whether more than two hours have passed since the client last ate.
Consent and risk disclosure
The client must sign and date a consent form explaining the tattoo procedure, that tattooing is permanent, that removal may be incomplete and leave scarring, and that complications may include bruising, scarring, bleeding, infection, allergic reactions to inks, and nerve or tissue damage.
Minor consent
A client under 18 requires written consent from a parent or guardian. The parent or guardian must sign in the tattooist’s presence, certify the information as true and accurate under pains and penalties of perjury, and receive the required disclosures before signing.
Procedure restrictions
Do not perform a tattoo on someone who is obviously under the influence of intoxicating beverages or chemical substances. The tattooist must also assess the tattoo site and decline the procedure if an abnormality of the skin or underlying tissue is present.
Aftercare instructions
Provide both verbal and written tattoo aftercare instructions covering bandage care, expected healing, cleaning and ointment use, activity restrictions, possible side effects, signs of infection, and the shop’s contact number.
Complication records
If a complication occurs during the tattoo procedure, document it in the client’s record after the client has been appropriately cared for.
Recordkeeping
Maintain each client’s records for at least two years. Records are subject to inspection by the Director or a designee and must be made available to the Director if the business closes or changes ownership.
First-treatment disclosure acknowledgement
Before a new client’s first treatment, provide the required professional, infection-control, conduct, and complaint-process disclosures. Both the client and tattooist must sign the acknowledgement, and the tattooist must retain the signed original.
